The managing name of ConsenSys, one of the largest developers in the Ethereum ecosystem, thinks the US is investigating Ethereum.

Bill Hughes, ConsenSys’s global regulatory affairs director, commented on the possibility of the US Securities and Exchange Commission filing a lawsuit against the Ethereum Foundation.

He thinks that the SEC is investigating Ethereum, but commented, “I don’t think the SEC is considering filing a lawsuit against any Ethereum connected party.” He also made the following statement:

“They are probably going back and forth on which category Ethereum falls under in terms of laws protecting investors. In October 2023, the SEC allowed Ethereum-based futures ETFs to trade on securities exchanges. This implies that the underlying assets used in futures contracts are not securities.

The ConsenSys executive believes that it is dangerous for the Ethereum ecosystem for the SEC to change their views over time and says that this needs to be “closely monitored.”
